Private Law Invoices

On March 8, 2016, the Federal Court of Canada Ruled that laws in Canada are privately owned (the T-646 Ruling).  Under this Ruling, whomever drafted and lobbied for legislation now owns that legislation privately.  These new “owners” can charge people royalties to read the law, can charge governments for using of the law -all of the rights of private ownership now apply to legislation.

Prior to the Federal Court Ruling, PS Knight Co had registered copyright on our contributions to Canada’s electrical laws.  We don’t agree with privately owned laws of course, we filed our copyright as a legal fallback.  Our invoices demonstrate costs of private law to governments, and their non-payment demonstrates the Ruling’s invalidity to Court.

Well, after the Ruling, we used our fallback.  We invoiced the governments of Canada for their use of our private property.  We’ve been invoicing them every month ever since.

This is the consequence of private ownership of law; that even governments now have to pay the “owners” of law for the right to use, to quote from, and to enforce private laws.  But governments aren’t keen on consequences.

As of October 1, 2017, we have issued 266 monthly invoices under the T-646 Ruling to the various governments of Canada.  All 266 invoices remain unpaid.

Governments are assuming that the particulars of the T-646 Ruling are so surreal, the judge was so compromised, and the Ruling’s consequences so severe, that the Ruling will be overturned on appeal. 

But there’s a risk.  The sum of the 266 invoices now exceeds $3,800MM.  And that’s just one law owned by one company.  Yet most laws are contributed to or otherwise lobbied over, so most laws are now under private ownership.  Imagine the costs if the Ruling is upheld!
